1. Scope
These Terms of Service apply to the websites aiscend.fm and aiscend.wtf and all related services (collectively "AISCEND"), operated by disruptive gmbh, Lehargasse 7, A-1060 Vienna, company register number FN 371341 s.
By using the platform — including viewing the website, joining the waitlist, or submitting music — you agree to these Terms. If you do not agree, please do not use the platform.
2. Beta Disclaimer
AISCEND is in public beta.
- Data completeness: Chart data may be incomplete, delayed, or inaccurate. No claim of completeness or accuracy.
- Availability: No guarantee of continuous availability. The platform may be modified, restricted, or temporarily disabled at any time.
- Algorithm: The ranking methodology is in development and may change without notice.
- No purchases: No purchases or payments are processed during beta.
- Do not rely: Do not make commercial or critical decisions based solely on AISCEND data.
3. Service Description
AISCEND aggregates publicly available chart and streaming data from third-party platforms (currently Apple Music, Reddit, Suno, Udio and editorial sources) and produces a weekly, algorithmically ranked Top 50 chart for AI-related music.
AISCEND
- does not produce music and claims no copyright in listed tracks;
- does not certify whether a track is AI-generated (signal scores are probabilistic estimates, not proof);
- is not an official partner of any listed platform unless expressly stated;
- assumes no responsibility for the accuracy of source data.
4. Permitted and Prohibited Use
4.1 Permitted
Personal, non-commercial informational use. Short quotations from the chart (e.g. in articles or social posts) are permitted with attribution to AISCEND and a link back to the original page.
4.2 Prohibited
- Automated extraction (scraping): no systematic, automated retrieval of chart data by bots, spiders, crawlers, or similar without express written permission.
- Commercial reuse: no use of AISCEND data in commercial products, databases, or services without a licence.
- Misrepresentation: no presentation of AISCEND data as official or certified.
- Submission abuse: no submission of third-party music without rights-holder authorisation; no spam.
- Unlawful content: no use of the platform to distribute illegal content, including copyright or personality-rights infringement.
5. Artist Submissions
By submitting a track you warrant:
- You are the rights holder or have express authorisation from the rights holder.
- The submission does not infringe third-party rights (copyright, trademark, personality rights).
- You consent to AISCEND displaying your artist name and track title in the chart.
- Submission does not entitle you to inclusion in the chart; AISCEND decides at its sole discretion.
By submitting, you grant AISCEND a non-exclusive, worldwide, royalty-free licence to use and display your artist name, track title, submission metadata, and track link within the AISCEND service.
6. Intellectual Property
AISCEND content: ranking algorithm, design, AISCEND logo, editorial text and other original content are protected under Austrian copyright law (UrhG). Reproduction, distribution, or public performance without consent is prohibited.
Third-party content: all listed tracks, artist names, cover art, and platform-specific data remain the property of their respective rights holders. AISCEND claims no ownership.
Takedown: If your rights are infringed, contact us via the takedown process.
7. Limitation of Liability
The platform is provided "as is". To the maximum extent permitted by law, disruptive gmbh makes no warranty as to the accuracy, completeness, or timeliness of chart data, signal scores, or other content.
To the extent permitted by law, disruptive gmbh is not liable for:
- indirect or consequential damages, lost profits, or data loss;
- damages arising from use or inability to use the platform;
- inaccurate third-party platform data;
- score misclassifications, provided the mandatory notices were clearly visible.
This limitation does not apply to damages caused by gross negligence or wilful misconduct, to personal injury, or to mandatory statutory liability.
8. Privacy
The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.
9. Changes
disruptive gmbh may change these Terms with effect for the future. Material changes are announced on the website and, where possible, communicated by email to registered users. Continued use after publication constitutes acceptance.
10. Governing Law and Jurisdiction
Austrian law applies, excluding the CISG and conflict-of-laws rules.
Consumers: Court of the consumer's domicile or Vienna, as applicable under EU Regulation 1215/2012 ("Brussels I-bis").
Businesses: Exclusive jurisdiction: Handelsgericht Wien.
EU ODR: ec.europa.eu/consumers/odr. We are not obliged and do not voluntarily participate in consumer arbitration proceedings unless legally required.
11. Severability
If individual provisions are or become invalid, the remaining provisions remain effective. Any invalid provision shall be replaced by a valid one that most closely matches its economic purpose.
